Terms of Service

These terms apply to Bluegrass CRM, a hosted customer and job management service provided by Bluegrass Software, Kentucky ("Bluegrass", "we", "us"). A business that signs up ("customer") and every person who uses the service for it ("user") agrees to them. A separate written agreement with a customer takes precedence over these terms where the two differ.

1. The service

Bluegrass CRM lets a customer record its clients, jobs, schedules, payments received, job costs, notes, photos and documents, and create estimates and invoices. We may improve or change features over time. We will tell customers before removing a feature they rely on where reasonably possible.

2. Accounts and access

3. Your data

4. Acceptable use

Do not use the service to break the law, to store or send content you have no right to, to harass anyone, to try to get into another company's information or our systems, to interfere with the service, or to resell it without our permission.

5. Money features

Payment tracking, job costs, profit and margin figures, estimates and invoices are tools to help run a business. They are not accounting, tax or legal advice, and the service does not process payments. The customer is responsible for reviewing its own figures, documents and the terms printed on them.

6. Fees

Fees, billing and payment terms are agreed with each customer. If fees are not paid, we may pause the customer's account: its users cannot use it while it is paused, and nothing is deleted. Access returns when the account is brought up to date.

7. Suspension and ending service

8. Availability and support

We work to keep the service available and reliable, but it may sometimes be unavailable, for example during maintenance or problems with our providers. We do not promise a specific uptime. Support is by e-mail.

9. Our software

Bluegrass owns the Bluegrass CRM software. These terms give customers and users the right to use it while they are in good standing; they do not transfer ownership. If you send us suggestions, we may use them without obligation.

10. Disclaimers

Except as stated in these terms or a written agreement, the service is provided "as is" and "as available", without warranties of any kind, to the extent the law allows.

11. Limitation of liability

To the extent the law allows, Bluegrass is not liable for indirect, incidental, special or consequential damages, or for lost profits, revenue or data, and our total liability for any claim relating to the service is limited to the fees the customer paid us for the service in the three months before the claim.

12. Changes to these terms

We may update these terms. We will update the date above and tell customers about important changes before they take effect. Continuing to use the service after that means accepting the updated terms.

13. Governing law

These terms are governed by the laws of the Commonwealth of Kentucky, USA.
